Terms of Service
These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for using the mobile
application “DayCity” (hereinafter referred to as the “App”), provided by Orude Inc. (hereinafter referred
to as the “Company”).
By using the App, users are deemed to have agreed to these Terms.
Article 1 (Application)
These Terms apply to all relationships between the user and the Company regarding the use of the App.
Article 2 (Definitions)
- “User” means any individual who uses the App.
- “Content” means any images, data, or snapshots provided by the App.
Article 3 (Registration and Use)
- The App identifies users through anonymous authentication provided by Firebase.
- Users gain the right to use the App upon agreeing to these Terms.
Article 4 (Fees and Subscription)
- The App can be downloaded free of charge.
- Some features (such as extended functionality and unlimited access) require a paid subscription (Premium
Plan). A free trial period may be provided for first-time subscribers.
- Subscriptions are purchased through the App Store.
- Purchased subscriptions cannot be refunded for any reason, except as required by law. Refunds follow the
policies of the App Store.
- By completing the purchase, the user is deemed to have given valid and irrevocable consent to the
payment.
- Subscription status is managed via the user's Apple ID.
Article 5 (Prohibited Conduct)
Users shall not engage in any of the following acts when using the App:
- Acts that violate laws or public order and morals
- Infringing upon the copyrights, portrait rights, privacy, honor, or other rights of third parties
- Unauthorized redistribution, reproduction, or commercial use of the Content provided by the App
- Unauthorized access, reverse engineering, decompiling, or modifying the App
- Transmitting or posting computer viruses or other harmful programs
- Overloading or disrupting the App or network systems
- Impersonating other individuals or entities
- Advertising, solicitation, or commercial activities without permission
- Providing benefits to antisocial forces
- Any other conduct that the Company reasonably deems inappropriate
If a user violates any of the above, the Company may suspend or delete the user’s access without prior
notice.
Article 6 (Intellectual Property Rights)
- All intellectual property rights related to the App, including software, designs, text, and provided
images, belong to the Company or rightful owners.
- Users are granted a limited, non-exclusive, non-transferable license to use the Content solely within
the scope of using the App (e.g. viewing, setting as widgets).
- The Company may use anonymized usage data for purposes such as quality improvement, troubleshooting, and
statistical analysis.
Article 7 (Disclaimer)
- The Company shall not be liable for any damages arising from the modification, suspension, or
termination of the App.
- The Company does not guarantee the accuracy, completeness, or permanent availability of the provided
city snapshots.
- The App uses external services (including Firebase, App Store), and the Company assumes no
responsibility for damages resulting from their failures or specification changes.
- The Company shall not be involved in or liable for any disputes between users or between users and third
parties.
Article 8 (Changes and Suspension of the Service)
The Company may suspend or interrupt all or part of the App without prior notice in the following cases:
- When performing system maintenance or inspections
- When operation becomes difficult due to server or network failure, excessive access, unauthorized
access, or usage limits on AI generation
- When operation is impossible due to natural disasters, power outages, or other force majeure events
- When the Company otherwise deems it necessary for operational reasons
The Company shall not be liable for any damages resulting from such suspension or interruption.
Article 9 (Notification and Modification)
- The Company may notify users through in-app displays or postings on the Company’s website.
- The Company may revise these Terms as necessary. Revisions shall take effect upon posting in the App or
on the website.
Article 10 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan.
Any disputes arising out of or relating to the App shall be subject to the exclusive jurisdiction of the
Tokyo District Court as the court of first instance.
